Unless stated otherwise in writing, Oliver Howard Art is not affiliated with, endorsed by, sponsored by, licensed by, approved by, or officially connected with any animation studio, film studio, production company, publisher, rights holder, brand, character owner, or other third party.

All third-party intellectual property — including characters, titles, trademarks, logos, films, shows, images, and related creative works — belongs to its respective owners.

The work sold here is not original production artwork, not an original production cel, not official studio merchandise, not an authenticated studio artifact, and not a substitute for any officially licensed collectible.

Any documentation, certificate, card, receipt, or description provided with a piece identifies it solely as handmade artwork created by Oliver Howard Art. It does not certify that the piece is an original studio production cel, official animation artifact, or licensed third-party product.


Nature of the Artwork

Every piece offered here is a handmade physical artwork, such as a hand-painted animation-style cel study or archival cel recreation produced using traditional materials, methods, and finishing techniques inspired by classic hand-drawn animation production.

These are technical, labor-intensive works created by hand. Unless explicitly stated otherwise, they are not prints, mass-produced reproductions, or digitally generated imagery.

Because the work is made by hand, natural variation in brush character, surface texture, paint layering, registration, linework, finish, and color is inherent and expected. These qualities are part of the handmade nature of the work and are not defects.

We make reasonable efforts to describe each piece accurately in terms of size, materials, finish, and condition. However, photographs can only approximate how color, surface, texture, and finish appear in person. Screen settings, lighting, cropping, and photography may affect how artwork appears online.

No two handmade pieces are identical.


Commissions & Inquiries

Submitting a commission inquiry does not guarantee acceptance.

Oliver Howard Art may accept, decline, request clarification, or request changes to any project based on schedule, materials, complexity, artistic fit, technical feasibility, reference quality, legal considerations, shipping limitations, or other business reasons.

Commission work begins only after:

  1. The project is accepted;
  2. A quote is provided;
  3. The quote is approved by the customer; and
  4. Required payment is received.

You may submit reference images, notes, descriptions, screenshots, size preferences, or other materials as part of your inquiry.

By submitting reference materials, you represent that:

  • You have the right to share those materials with Oliver Howard Art for the purpose of evaluating, quoting, planning, and creating the requested commission;
  • Your submission does not knowingly violate anyone’s privacy, publicity, intellectual property, or legal rights;
  • You are requesting handmade physical artwork for personal display or collection purposes;
  • You understand that Oliver Howard Art may decline any request for artistic, technical, business, legal, or practical reasons.

Reference materials submitted for a commission are used only to evaluate, quote, plan, communicate about, and create that specific project. We do not sell customer-submitted reference materials or use them for unrelated purposes.

If a commission does not move forward, related materials may be deleted when no longer needed.

We reserve the right to decline any request involving elements that could falsely imply official affiliation, licensing, endorsement, production origin, or authentication by a third party, including logos, official seals, certificates, production labels, studio marks, watermarks, signatures, copyright notices, or other identifying marks tied to third-party rights holders.


Personal Use

Unless otherwise agreed in writing, all artwork is sold for personal display and collection only.

Purchased artwork, commission designs, process images, reference work, and related materials may not be used for:

  • Commercial reproduction;
  • Merchandise;
  • Advertising;
  • Digital products;
  • NFTs or blockchain-related products;
  • Mass production;
  • Licensing;
  • Resale as an official item;
  • Any use that implies official affiliation with a third-party rights holder.

You may resell a physical piece you purchased from Oliver Howard Art, but it must be represented accurately as a handmade Oliver Howard Art piece.

It may not be represented as an original production cel, official studio item, licensed collectible, authenticated studio artifact, official third-party product, or item created by any studio, production company, publisher, brand, or rights holder.

Purchasing physical artwork does not transfer copyright, reproduction rights, commercial rights, licensing rights, merchandising rights, or digital rights unless expressly agreed in writing.


Pricing & Payment

Shop pieces are priced as listed at the time of purchase. Full payment is due at checkout for ready-made artwork.

Commission pricing is provided by quote after reviewing the inquiry and may vary based on size, materials, complexity, timeline, availability, shipping needs, and other project-specific factors.

Commission payment follows the invoice or written payment instructions provided. Work does not begin until the required payment is received.

Prices may change at any time before an order or invoice is finalized. Once a commission quote is accepted and paid, the price is set unless the project scope changes, additional work is requested, or new requirements are added.

Payments may be processed through Shopify, Shopify Payments, Shop Pay, PayPal, credit card processors, or other payment providers made available through the website, checkout, or invoice process.

Oliver Howard Art does not intentionally collect or store your full payment card number. Payment information is handled by Shopify and/or third-party payment processors according to their own terms and privacy policies.


Cancellations, Revisions & Returns

All ready-made artwork sales are final unless otherwise required by applicable law.

For commissions, cancellations and refunds are not available once materials have been ordered, planning has begun, or physical work has started.

Cancellation requests made before that point may be considered case by case.

Revisions are handled individually. Because this is physical handmade artwork, changes are not always possible after certain stages of production. Additional revisions, major changes, size changes, material changes, or new reference directions may require additional payment.

We do not accept returns or exchanges on completed artwork, custom commissions, handmade pieces, or final-sale items except where required by applicable law.

If your order arrives damaged, contact us promptly with photos of the packaging, artwork, and damage. We will review the situation and work with you on next steps, including a shipping claim where applicable.

Damage claims may require photographs, packaging retention, carrier inspection, or other documentation requested by the shipping carrier.


Timelines & Shipping

Estimated timelines are estimates only, not guarantees.

Commission schedules can be affected by communication delays, material availability, drying and curing time, project complexity, illness, weather, carrier disruptions, customs delays, supply shortages, platform outages, or other circumstances outside our control.

We will make reasonable efforts to communicate about significant delays.

We ship domestically and internationally on a case-by-case basis using whichever carrier is most appropriate for the piece. Shipping carriers may include USPS, UPS, FedEx, DHL, or another available carrier.

Customers are responsible for providing accurate shipping information.

Oliver Howard Art is not responsible for delays, losses, returned packages, or additional costs caused by incorrect or incomplete shipping information provided by the customer.

International customers are responsible for any customs duties, taxes, import fees, brokerage fees, restrictions, delays, or other charges imposed by their country, customs authority, or shipping carrier.

We are not responsible for delays or losses caused by carriers, customs, weather, strikes, force majeure events, platform outages, or other events outside our reasonable control.


Photography, Portfolio & Testimonials

We may photograph, record, archive, and publicly display completed artwork, works in progress, process images, and related non-sensitive project details on this website, social media, portfolio materials, or promotional materials.

If you would like your commission kept private, please tell us in writing before work begins. We will make reasonable efforts to honor accepted private commission requests.

We may choose not to publicly post certain work for artistic, business, legal, privacy, or rights-related reasons.

If you share a testimonial, review, comment, message, tag, or feedback with us, you give us permission to display it on our website, social media, portfolio, or promotional materials unless you specify otherwise.

We may edit testimonials for length, spelling, clarity, grammar, or formatting, but we will not intentionally change the meaning.

You may contact us at any time to request removal of a testimonial or identifying information.


Privacy Policy

This Privacy Policy explains how Oliver Howard Art collects, uses, stores, and shares personal information when you visit the website, submit a commission inquiry, upload reference materials, purchase artwork, communicate with us, or otherwise interact with our services.

If a commission is rejected, declined, or not pursued, related materials may be manually deleted when no longer needed.

Retention

We keep personal information only as long as reasonably necessary for the purposes described in these Terms & Policies, including to complete orders, respond to inquiries, maintain business records, comply with legal obligations, resolve disputes, prevent fraud, and enforce our terms.

Order records, invoices, payment records, shipping records, and related communications may be retained as needed for business, tax, accounting, legal, or dispute-resolution purposes.

Rejected or declined commission inquiries may be manually deleted when no longer needed.

Security

We take reasonable steps to protect personal information, but no website, email system, payment processor, shipping system, or online service can guarantee perfect security.

To the fullest extent permitted by law, Oliver Howard Art will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from use of the website, commission process, artwork purchase, shipping delay, third-party service, or customer misuse of purchased artwork.

To the fullest extent permitted by law, our total liability for any claim related to an order or commission will not exceed the amount paid for the specific item or service giving rise to that claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

These Terms & Policies are governed by the laws of the State of Illinois and applicable United States law, without regard to conflict-of-law principles.

Where permitted by law, disputes related to these Terms & Policies, the website, purchases, or commissions will be handled in the state or federal courts located in Illinois.
